Terms of Service

1. Acceptance of Terms

By accessing or using the Bracha Homes website, mobile application, or any related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

These Terms constitute a legally binding agreement between you and Bracha Homes (Pty) Ltd, a company incorporated in South Africa ("Bracha Homes", "we", "us", or "our").

2. Platform Description

Bracha Homes operates an online property portal that enables registered users to browse, list, and enquire about residential and commercial properties for sale or rent in South Africa. We act as an intermediary platform and do not directly sell, purchase, rent, or manage properties.

3. User Accounts

To access certain features of the Platform, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and not share it with third parties
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we believe are being used fraudulently.

4. Listing Content

Users who submit property listings ("Listers") represent and warrant that:

• All information provided is accurate, complete, and not misleading
• They have the legal right to list the property (as owner, authorised agent, or with written permission)
• Photographs and descriptions are truthful representations of the property
• Pricing is stated in South African Rand (ZAR) unless explicitly stated otherwise
• The listing complies with all applicable South African laws, including the Property Practitioners Act 22 of 2019

Bracha Homes reserves the right to review, edit, or remove any listing that violates these Terms or our content policies, without notice.

5. Prohibited Uses

You may not use the Platform to:

• Post fraudulent, misleading, or fictitious listings
• Scrape, harvest, or systematically extract data from the Platform without written consent
• Interfere with or disrupt the integrity or performance of the Platform
• Attempt to gain unauthorised access to other user accounts or our systems
• Transmit spam, unsolicited communications, or malicious code
• Engage in any activity that violates applicable South African law

6. Intellectual Property

All content on the Platform — including text, graphics, logos, software, and the compilation thereof — is the property of Bracha Homes or its licensors and is protected by South African and international copyright law. You may not reproduce, distribute, or create derivative works without our express written permission.

7. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. Bracha Homes does not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components. Property information is provided by listers and we do not independently verify its accuracy.

8. Limitation of Liability

To the maximum extent permitted by South African law, Bracha Homes shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Platform, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Gauteng, South Africa.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date above and, where appropriate, sending a notification to registered users. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
